The EURUSD on the H4 time frame was in an uptrend until 16 January when a last higher top was recorded at 1.08735.

A closer look at the Momentum Oscillator reveals negative divergence between point “a” and “b” when comparing the tops at 1.08671 and 1.08735. This could have alerted technically inclined traders that the bullish trend might lose power.

After the higher top at 1.08735, the price dropped through the 15 and 34 Simple Moving Averages and the Momentum Oscillator followed by moving into bearish territory.

A possible critical support level formed when a lower bottom was recorded on 18 January at 1.07654. The bulls are currently trying to drive the price higher.

If the price of EURUSD breaks through the critical support level at 1.07654, then three possible price targets may be projected from there.

Attaching the Fibonacci tool to the lower bottom at 1.07654 and dragging it to near a resistance level that was created on 17 January at 1.08734, the following targets may be anticipated:

  • The first target can be estimated at 1.06987 (161.8%).
     
  • The second price target may be calculated at 1.05907 (261.8%).
     
  • The third and final target can be expected at 1.04160 (423.6%).

 

If the resistance level at 1.08734 is broken, the above scenario must be re-examined.

After all, this could be a case of Euro bulls consolidating around 1.087, before mustering enough mass to punch past the immediate resistance levels that had thwarted EURUSD’s upside since last week.

 

As long as the bears continue their negative mindset and supply continues overcoming demand, the outlook for the EURUSD currency pair will remain bearish.

On December 1, the U.S. Court of Appeals for the Ninth Circuit affirmed in part and reversed in part a district court’s dismissal of a putative class action brought against a French cryptocurrency wallet provider and its e-commerce vendor for lack of personal jurisdiction. As previously covered by InfoBytes, plaintiffs—customers who purchased hardware wallets through the vendor’s platform between July 2017 and June 2020—alleged violations of state-level consumer protection laws after a 2020 data breach exposed the personal contact information of thousands of customers. Plaintiffs contended, among other things, that when the breach was announced in 2020, the wallet provider failed to inform them that their data was involved in the breach, downplayed the seriousness of the attack, and did not disclose that the attack on its website and the vendor’s data theft were connected. The district court held that it did not have jurisdiction over the French wallet provider, and ruled, among other things, that the plaintiffs did not establish that the wallet provider “expressly aimed” its activities towards California in a way that would establish specific jurisdiction, and “did not cause harm in California that it knew was likely to be suffered there.” The district court further held that the fact that the vendor was headquartered in California at the time the breach occurred was not sufficient to establish general jurisdiction because the vendor moved to Canada before the class action was filed. “Courts have uniformly held that general jurisdiction is to be determined no earlier than the time of filing of the complaint,” the district court wrote, dismissing the case with prejudice.

On appeal, the 9th Circuit concluded that dismissal was improper because the French wallet provider’s contracts with California were sufficient to establish jurisdiction under the “purposeful availment” framework. The appellate court explained that because the French wallet provider sold roughly 70,000 wallets in the state, collected California sales tax, and shipped wallets directly to California addresses, the “facts suffice to establish purposeful availment because [the French wallet provider’s] contacts with the forum cannot be characterized as ‘random, isolated, or fortuitous.’” However, the 9th Circuit limited the claims to only those brought by California residents under the state’s consumer protection laws. A forum-selection clause in the French wallet provider’s privacy policy and terms of use documents provided that disputes would be subject to the exclusive jurisdiction of French courts, the appellate court said, which was enforceable except with respect to the class claims of California residents brought under California law “because it violated California public policy against waiver of consumer rights under California’s Consumer Legal Remedies Act.”

The 9th Circuit also determined that the district court abused its discretion in disallowing any jurisdictional discovery concerning the defendant e-commerce vendor. Explaining that the e-commerce vendor employs more than 200 people who work remotely from California, including a data-protection officer (DPO) who may have played a role related to the data breach, the appellate court wrote that “[b]ecause more facts are needed to determine whether those activities support the exercise of jurisdiction, we reverse the district court’s denial of jurisdictional discovery with respect to the DPO’s role and responsibilities and his relationship to [the e-commerce vendor], which processed and stored the data.”

Birmingham: Pakisan’s Nadeem Arshad on Sunday scripted history, not just for his country but for the entire South Asia as he breached the 90m mark in Javelin Throw to clinch gold in the Commonwealth Games 2022.

The throw even left Anderson Peters shocked along with all the others who were lucky enough to witness the incident.

“Today, I feel good and after the first throw, I thought I could throw even over 90m today. But it is OK as I have more competitions coming this year,” Chopra said after his second place finish,” India’s Olympic gold medalist Neeraj Chopra had said earlier after a podium finish at the Diamond League.

The coveted 90m-mark is considered as the gold standard in the world of javelin throw and to have achieved that at the Birmingham Games 2022 was a colossal effort from the Pakistan athlete.

Chopra missed the Commonwealth Games 2022 due to an injury but must must be feeling proud of his good friend Arshad, who had always spoken highly of the great camaraderie that they share on an off the field.

“I spoke to Arshad after the competition ended,” Chopra had said after winning silver in the World Athletics Championships final in Eugene, Oregan last month.

“I told him that he did very well. He replied that he had issues with his elbow. I further congratulated him for a great throw and it was a great comeback from his injury and it was commendable that he threw the javelin over 86 metres,” he further added.

NEW YORK — T- Mobile has agreed to pay $350 million to customers affected by a class action lawsuit filed after the company disclosed last August that personal data like Social Security numbers had been stolen in a cyberattack.

In a Securities and Exchange Commission filing on Friday, the mobile phone company said the funds would pay for claims by class members, the legal fees of plaintiffs’ counsel and the costs of administering the settlement. It also said it would spend $150 million next year and in 2023 to fortify its data security and other technologies.

T-Mobile said the settlement contains no admission of liability, wrongdoing or responsibility by any of the defendants.

The company said that it expects court approval of the terms of the settlement as early as December 2022.

Nearly 80 million U.S. residents were affected by the breach. In addition to Social Security numbers, other information breached included names and information from driver’s licenses or other identification.

T-Mobile, based in Bellevue, Washington, became one of the country’s largest cellphone service carriers, along with AT&T and Verizon, after acquiring rival Sprint in 2020. It reported having a total of 102.1 million U.S. customers after the merger.

T-Mobile said it expects to record a total pre-tax charge of roughly $400 million in the second quarter of this year.

T-Mobile has agreed to pay $500 million to settle a class-action lawsuit stemming from the 2021 hack that it says exposed around 76.6 million US residents’ data. According to the proposed agreement filled on Friday, which you can read in full below, T-Mobile will put $350 million into a settlement fund to go to lawyers, fees, and, of course, to people who file claims. It’ll also be obligated to spend $150 million on “data security and related technology” during 2022 and 2023, in addition to what it had already budgeted for.

In August, the company announced that its systems had been breached, following reports that Social Security numbers, names, addresses, and driver’s license information for over 100 million of its customers was for sale. While the number proved to be slightly inflated, T-Mobile’s figure of how many people were impacted continued to rise over the rest of the month. T-Mobile’s CEO called this security breach — its fifth in four years — “humbling.”

The proposed settlement agreement still has to be approved by a judge, but if it is, T-Mobile will have 10 days to put money in the fund to cover the costs of notifying people who are eligible to claim. According to the settlement, that covers “the approximately 76.6 million U.S. residents identified by T- Mobile whose information was compromised in the Data Breach,” with a few caveats for some of the carrier’s employees and people close to the judges that presided over the case. In the interest of full disclosure, that could very well mean that I’m eligible to apply for compensation, as I was a T-Mobile customer when the hack occurred.

The settlement agreement doesn’t contain estimates on how much each claimant can expect to receive, though it’s difficult to estimate that kind of thing until it’s clear how many people will make claims.

The lawsuit that T-Mobile is hoping to settle here accused the company of failing to protect its past, present, and prospective customers’ data, not properly notifying people who may have been impacted, and overall having “inadequate data security.” T-Mobile denies these allegations in the agreement, saying that the settlement doesn’t constitute an admission of guilt. In a filing with the Securities and Exchange Commission, the carrier says it “has the right to terminate the agreement under certain conditions” laid out in the proposed agreement but says that it anticipates having to pay out the claims.

Outside of this lawsuit, there have been other responses to T-Mobile’s data breach and others like it. The FCC proposed new rules surrounding such attacks, which aim to improve how a company communicates with people about their data.

MILAN, July 11 (Reuters) – Italy’s data protection authority has formally warned Chinese-owned short video-sharing app TikTok about an alleged breach of existing EU rules to safeguard users’ privacy, the watchdog said on Monday.

TikTok, which has seen rapid growth worldwide particularly among teenagers, had told users in recent weeks that it was going to deliver targeted advertising to them but had not requested consent for using data stored in their devices, the Italian watchdog said.

A spokesperson for TikTok in Italy had no immediate comment.

The Italian authorities said they were also concerned that inappropriate advertising could be directed at minors given the problems that TikTok has faced in accurately monitoring the ages of its users.

But he reserved his harshest comments for Thompson, whom he described as “weak-minded” and part of a “gullible” throng of Trump backers who couldn’t separate his claims from reality. Walton ordered Thompson immediately detained, forgoing the typical release of defendants until their sentencing.

“The inevitable reality is that whether he does time now or does time later, he’s got to do time,” Walton said just before ordering him held.

He added that he considered Thompson a flight risk because he tried to flee the police on Jan. 6 after they began to question him about his theft of a coat tree from a Capitol office. Walton also said he didn’t think Thompson was candid during his testimony, when he took the stand to try to explain his actions.

The case presented a tightrope for prosecutors as the Justice Department continues to investigate figures in Trump’s orbit for their roles in motivating and stoking the conditions that led to the mob attack on the Capitol. A slew of defendants have argued in court filings that they took their cues from Trump that day, interpreting his call to “fight like hell” against the results of the 2020 election as a command to storm the Capitol. Thompson made that claim the centerpiece of his defense.

In closing arguments, Assistant U.S. Attorney William Dreher called Thompson’s argument a “sideshow” meant to whip up the jury’s anger at Trump rather than focus on the obvious violations of law that Thompson committed.

“Defense counsel wants you to focus so much on what President Trump said on the morning of Jan. 6. He wants you to forget what his client did on the afternoon of Jan. 6,” Dreher said.

“He wants you to think you have to choose between President Trump and his client, Mr. Thompson, right? That you can only find that one of them committed a crime that day or that one of them is worse than the other,” Dreher continued. “Ladies and gentlemen, you don’t have to choose.”

Trump’s ability to influence his supporters to march on and breach the Capitol has been a focus of the Jan. 6 select committee in Congress. It has pointed to claims from defendants like Thompson — as well as Trump’s lengthy silence during the riot — as evidence that the former president bears singular, perhaps criminal, responsibility for the violence that broke out that day.

Dreher didn’t contradict that narrative but urged jurors to set it aside.

“This is not president Trump’s criminal trial,” he said. “It is not up to you to decide whether anyone other than the defendant should be prosecuted for any of the crimes charged. The fact that another person may also be guilty is no defense of a criminal charge. The question of the possible guilt of others should not enter your thinking.”

Thompson was convicted on six charges: obstruction of an official proceeding — which carries a maximum 20-year sentence — as well as theft of government property, entering and remaining in a restricted building, disorderly and disruptive conduct in a restricted building, disorderly conduct in the Capitol, and parading in the Capitol. The jury deliberated for about three hours.

In Thompson’s closing argument, attorney Samuel Shamansky appealed to the jury to consider “human nature.” He reminded them that Thompson had spent nearly a year out of work before Jan. 6, isolated amid the pandemic and consuming a firehose of pro-Trump disinformation and propaganda.

Shamansky didn’t dispute the bulk of the factual case presented by prosecutors: Thompson entered the Capitol after Trump’s speech, joined a mob in ransacking the Senate parliamentarian’s office and stole a coat rack and bottle of liquor during the unrest. He stood by as rioters assaulted police in a Capitol tunnel and ran away from officers that evening when they approached him to ask about the coat rack.

But Shamansky urged the jury to consider the “mental” impact that Trump’s words had over time.

“He consumed these lies and this misinformation,” Shamansky said, calling Trump an “evil and sinister man who would stop at nothing to get his way on Jan. 6.” Shamansky described Thompson as a “pawn” in Trump’s “sick game” to remain in power.

“In your hearts, in your heads,” Shamansky said to the jury, “do the right thing.”

The arguments capped a trial in which there was unusually broad agreement between prosecutors and the defense attorneys about the defendant’s conduct. Thompson took the stand to argue that he was in Trump’s thrall when he committed the actions he took, but acknowledged knowing that they were wrong at the time.

Thompson’s wife also testified that she witnessed her husband become increasingly radicalized during Trump’s presidency, and that it became particularly acute when he became unemployed in March 2020.

Queensland Premier Annastacia Palaszczuk has denied her cabinet is ever asked to vote and says a union leader instructing a minister on where to place his support was “stakeholder consultation”. The Liberal National Party wants the corruption watchdog to probe the 2015 incident for a possible breach of cabinet confidentiality. The email conversation involving former Electrical Trades Union secretary Peter Simpson and then energy minister Mark Bailey was first revealed in a report made public on Wednesday night. Mr Simpson emailed Mr Bailey telling him he would get “three options to vote upon” at a cabinet meeting about workers compensation the next day. “We obviously hope you go for A,” the ETU secretary wrote at the time. Mr Bailey replied: “Will give you a call in the morning comrade, M.” When asked on Friday if it was normal for union leaders to instruct ministers how to vote in cabinet, Ms Palaszczuk was incredulous. She insisted that could not have happened because there were no votes in her cabinet meetings. “No one votes at cabinet,” Ms Palaszczuk told reporters. “It’s not like a parliament where you come in and take votes, cabinet does not operate that way.” The premier said the emails between Mr Simpson and Mr Bailey were “stakeholder consultation”. It was normal practice, she said, for ministers to speak with various interest groups about upcoming policy and law changes. Ms Palaszczuk denied it was “disturbing” that Mr Simpson knew what was on the cabinet agenda ahead of time. “That is a hallmark of good government, to have stakeholder consultation,” she said. Former state archivist Mike Summerell’s 2017 report, which contained the controversial emails, was published for the first time on Wednesday night. He wrote that the emails could indicate a breach of the ministerial code. “The seeming ETU awareness of what Cabinet was discussing or about to discuss, sometimes in detail, was alarming,” the report said. LNP leader David Crisafulli said the premier should refer the matter to the Crime and Corruption Commission if she “values integrity”. “This is an issue of cabinet documents being shopped around like they’re some sort of trivial bit of information. These are cabinet documents, going to union bosses,” the Opposition leader said. He said union officials could still be instructing government ministers how to vote in cabinet, which was unfair to voters. “Because Queenslanders don’t get to vote for union officials, they get to vote for politicians,” Mr Crisafulli said. “Now this is a complete breach in the way the democratic process should work and anything short of an inquiry from the CCC won’t cut it.” The corruption watchdog was made aware of the emails between Mr Bailey and Mr Simpson, who died in 2020, five years ago. The CCC said in their 2017 investigation that Mr Bailey had not broken any law by using his private email for official purposes, but it was in breach of ministerial standards. It also said while using private emails for official business was a corruption risk, there was no evidence of wrongdoing in this case. “The CCC did not identify any evidence to support allegations Minister Bailey had used his personal email account to engage in negotiations with the Electrical Trades Union that would amount to corrupt conduct,” the watchdog’s report said. Washington: The Joint Base Andrew military base near Washington DC from where Vice President Kamala Harris and her husband had just taken off, has been put on lockdown on Sunday (local time) after reports of an “armed individual” on base, according to reports.

“(The) Guards stopped the shuttle reporters take from the terminal. They had rifles out and searched our van,” Scott Detrow, NPR’s White House correspondent, who is currently at the base and is a part of the press pool reporter for the vice president, said.

Joint Base Andrews is located in Prince George’s County in Maryland and serves as the home base for several planes that are used by the President of the United States.

US President Joe Biden was not at the facility when the incident began, and Vice President Kamala Harris and her husband second gentleman Doug Emhoff had left on Marine Two for the Naval Observatory . According to a White House official, the four cabinet secretaries who were travelling with VP Harris were safely off-base.

“We are still on our shuttle, and still are awaiting any sort of official statement on the extent of what’s happening at JBA right now. A guard who searched our shuttle told us it is a confirmed “armed individual” but that no shots were fired,” Detrow said in his pool report.

The vice president and several cabinet members had just landed at the military base after a trip to Selma for a “Bloody Sunday” anniversary event.

Reports are coming in that an individual was held at the Joint Base Andrew military facility and the base has been sealed off after the security breach and an investigation is underway, according to pool reporters.
